THE POET MIGUEL HERNÁNDEZ IS IN THE PUBLIC DOMAIN

The National Library of Spain (BNE) has declared the work of the famous writer Miguel Hernández free of copyright. This was made public in its annual list of creators whose works "can be edited, reproduced or broadcast publicly". This legal modification affects the creations of other 173 Spanish authors, all deceased in 1942.

Currently the Provincial Council of Jaén is in charge of guarding the Hernández file. For it, he divided his digitalized legacy completely between the Institute of Giennenses Studies and the Miguel Hernández - Josefina Manresa Museum. This last institution also recognizes the work of Manresa, the poet's wife, who preserved her husband's work during the dictatorship.

The Intellectual Property Law establishes a term of protection of copyright of 70 years. Nevertheless, as it is a writer who died before the regulations came into force, The period extended for another decade. This new condition of Hernández's writings will not have effects on unpublished works that may be discovered., since the people who publish them will be beneficiaries of them during 25 years.

Other authors declared in the public domain according to the BNE are: Eustaquio Jimenez, brother of Juan Ramón Jiménez and mayor of Moguer; Julio González, sculptor, cartoonist and collaborator of Pablo Picasso; the sculptor Julia Casagemas and the ENT doctor Fernando Asuero.

Two Ibizans are included among those included in this registry: The architect, stonecutter and foreman Joan Gómez Ripoll Campos and the journalist and former mayor of Ibiza, Bartholomew of Rosselló Tur. The Balearic representation is completed with the teacher and pedagogue from Mallorca Gabriel Comas y Ribas and the soldier also from Mallorca Ladislao López Bassa.
